1. Acceptance of Terms

By accessing or using any service provided by SMTPRoot ("we", "us", "our") at smtproot.com, you agree to be bound by these Terms of Service. If you do not agree to all terms, you must not use our services. These terms apply to all plans including shared hosting, reseller hosting, and any future services.

2. Account Registration & Responsibility

2.1 You must provide accurate, complete, and up-to-date information during registration. Submission of false or misleading information may result in immediate suspension without refund.

2.2 You are solely responsible for maintaining the confidentiality of your account credentials. All activity occurring under your account is your responsibility.

2.3 You must immediately notify us at support@smtproot.com if you suspect any unauthorized use of your account.

2.4 One account per customer. Creating multiple accounts to exploit promotions or bypass restrictions is prohibited.

3. Acceptable Use Policy

You may not use our hosting services for any of the following:

Violation of this policy will result in immediate suspension or termination without refund, and may be reported to law enforcement.

4. Billing & Payments

4.1 All prices are in Indian Rupees (INR) and include applicable taxes (GST at 18%). Prices are subject to change with prior notice.

4.2 Renewal invoices are generated 14 days before the due date. Services are suspended on the due date if payment is not received, and terminated 7 days after suspension.

4.3 A late fee of ₹99 may be applied to invoices not paid before suspension.

4.4 Payments are processed via Razorpay. We accept UPI, net banking, credit/debit cards, and wallets.

4.5 You are responsible for keeping your payment information up to date to avoid service interruption.

5. Service Availability & Uptime

SMTPRoot targets a 99.9% uptime guarantee for shared hosting plans. Scheduled maintenance will be communicated at least 24 hours in advance. Downtime caused by events outside our reasonable control (force majeure, DDoS attacks, third-party infrastructure failures) is not covered by the uptime guarantee. Downtime credits, if applicable, will be issued as account credits — not cash refunds.

6. Resource Usage

Hosting plans are subject to fair-use policies. Accounts found to be consuming excessive CPU, memory, or disk I/O that negatively impacts other customers may be suspended or asked to upgrade to a higher plan. We reserve the right to set reasonable resource limits on any account.

7. Backups

While we perform daily backups as a courtesy on eligible plans, you are ultimately responsible for maintaining your own backups. SMTPRoot is not liable for data loss. We strongly recommend keeping independent backups of all important data.

8. Suspension & Termination

8.1 By SMTPRoot: We may suspend or terminate your account immediately and without notice for violations of these Terms, non-payment, fraudulent activity, or actions that threaten our infrastructure or other customers.

8.2 By Customer: You may cancel your account at any time through the client portal. Cancellations take effect at the end of the current billing period. No prorated refunds are given for unused time.

8.3 Data After Termination: Upon termination, all account data including files, databases, and emails will be permanently deleted within 24 hours. We are not responsible for any data loss after termination.

9. Intellectual Property

All content on the SMTPRoot website (logos, text, design) is the intellectual property of SMTPRoot and may not be reproduced without written consent. Customer content hosted on our servers remains the customer's intellectual property.

10. Limitation of Liability

SMTPRoot's total liability for any claim arising from our services is limited to the amount paid by the customer for the service in the preceding one month. We are not liable for indirect, incidental, consequential, or punitive damages including loss of data, profits, or business opportunities.

11. Indemnification

You agree to indemnify and hold SMTPRoot harmless from any claims, losses, or damages arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify customers of material changes via email or a notice on the dashboard. Continued use of our services after changes constitutes acceptance of the updated terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of courts located in Telangana, India.
